2.1 Procedure

Titel: Heat accumulation plant in Lisbjerg Energy Park - Design and build contract 1, New\n VAK (Accumulation tanks incl. stair towers, walkway, handrails, pipes, valves, electricity\n and SRO, nitrogen and compressed air systems, instrumentation and safety equipment)

Beskrivelse: The project pertains to the turnkey contract for designing and constructing 2 pcs.\n heat accumulation tanks (hereinafter VAK) each with a usable volume of 50,000 m3,\n to be located in Energy Park Lisbjerg for Kredsløb Transmission A/S. The turnkey contract\n encompasses complete, fully operational VAK including design, supply, installation,\n and connection, as well as testing and commissioning with auxiliary equipment according\n to the complete tender material.
The entire construction project comprises multiple\n contracts, but these tender conditions solely apply to the turnkey contract for 2\n pcs. VAK. Referring to Article 65 of the Utilities Directive, it is stated that the\n turnkey contract in this tender will not be subdivided into (additional) subcontracts,\n as the Contracting Authority has determined that, due to the nature of the project,\n and the financial, liability and execution considerations, it is most suitably addressed\n under one turnkey contract. Further details of the project are provided in the tender\n material.
No remuneration will be granted for participation in this tender process.

As evidence that the tenderer or certain persons associated with the tenderer,\n cf. Section 135, subsection 2 of the Tender Act, are not subject to the exclusion\n grounds in Section 135, subsection 1 or 3, and Section 137, subsection 1, no. 1-5,\n of the Tender Act:
1) An extract from the relevant register or an equivalent document\n issued by a competent judicial or administrative authority, showing that the tenderer\n is not subject to one or more of the mandatory exclusion grounds in Section 135, subsection\n 1 of the Tender Act.
2) A certificate issued by the competent authority in the\n country concerned, demonstrating that the tenderer is not subject to the exclusion\n ground in Section 135, subsection 3 of the Tender Act.
For Danish tenderers,\n the proof may consist of a service certificate. Service certificates are issued by\n the Danish Business Authority.
If the country where the tenderer is domiciled\n does not issue the aforementioned certificates or documents, or if they do not cover\n all the cases specified in Section 135, subsection 1 and 3 of the Tender Act, they\n may be replaced by a Declaration under Oath. If an oath is not required in the relevant\n country, a Declaration on Honour may be used instead, in accordance with Section 153,\n subsection 2 of the Tender Act.
The documentation must not be older than 12 months\n from the date of obtaining the documentation.

Economic and financial minimum\n requirements
As evidence of compliance with the economic and financial minimum\n requirement, the tenderer must present a statement from a bank, another recognised\n financial institution or a surety insurance company, in which such bank, financial\n institution or surety insurance company declares: a) that within the framework of\n the applicant's/supplier's engagement with the bank, financial institution or surety\n insurance company, or within the applicant's/supplier's existing credit limit, there\n is currently capacity to provide the security required in the contract, and/or b)\n that the institution is prepared to provide the security required in the contract.

Professional\n and technical minimum requirements
The submitted reference list is considered\n sufficient documentation in itself, and the tenderer will not be requested to provide\n further evidence of their professional and technical competencies. However, the Contracting\n Authority reserves the right to contact the mentioned referees to verify the content\n of the references.

Beskrivelse: It is a minimum requirement that, when the Contracting Authority is obtaining documentation\n for the ESPD, a statement from a bank, another recognised financial institution or\n a surety insurance company can be provided where the bank, financial institution or\n surety insurance company confirms that at the time of application, a) within the context\n of the applicant’s engagement with the bank, financial institution or surety insurance\n company or the applicant’s existing credit limit, there is capacity to provide the\n security required in the contract section 12.1, and/or b) that they are prepared to\n provide the security required in the contract section 12.1.

The applicant must fulfil the following\n minimum requirements for technical and professional capabilities:
• The applicant\n must provide three references, each demonstrating experience with the design and construction\n of a VAK (heat accumulation tank) of at least 10,000 m3 put into operation.
Each\n reference should contain the following details:
- Client, contact person (name,\n phone number and email address)
- Total contract amount
- Implementation period,\n including the date of delivery and operation date
- Detailed description of the\n nature of the project
- Applicant's role and function in relation to the completed\n work
- Size of the VAK (heat accumulation tank)
- If relevant, a description\n of other VAK (heat accumulation tank) constructed on the same site within the same\n timeframe/schedule

The references must only describe projects where the works\n were executed within the last ten years from the application deadline.
If more\n than three references are submitted, only the first three listed will be considered.\n
The time of execution is counted from the delivery deadline. The reference requirement\n can be fulfilled with references where the tenderer acted as a contractor or subcontractor.\n It is crucial is that the tenderer carried out the work covered by the reference.

Title: Heat accumulation plant in Lisbjerg Energy Park - Design and build contract 1, New\n VAK (Accumulation tanks incl. stair towers, walkway, handrails, pipes, valves, electricity\n and SRO, nitrogen and compressed air systems, instrumentation and safety equipment)

Description: The project pertains to the turnkey contract for designing and constructing 2 pcs.\n heat accumulation tanks (hereinafter VAK) each with a usable volume of 50,000 m3,\n to be located in Energy Park Lisbjerg for Kredsløb Transmission A/S. Conflict of interest due to its participation in the procurement procedure: Pursuant to Section 136(1) of the Danish Public procurement Act, an applicant or tenderer\n will be excluded if the contracting authority can prove that in relation to the procurement\n procedure referred to, a conflict of interest, cf. Section 24(18), cannot be removed\n effectively by less radical means.

Direct or indirect involvement in the preparation of this procurement procedure: Pursuant to Section 136(2) of the Danish Public Procurement Act, an applicant or tenderer\n will be excluded if the inclusion will entail a distortion of competition as discussed\n in section 39 as a result of the prior involvement of economic operators in the preparation\n of the procurement procedure in relation to the procurement procedure referred to\n which cannot be removed by less radical

The applicant must fulfil the following\n minimum requirements for technical and professional capabilities:
• The applicant\n must provide three references, each demonstrating experience with the design and construction\n of a VAK (heat accumulation tank) of at least 10,000 m3 put into operation.
Each\n reference should contain the following details:
- Client, contact person (name,\n phone number and email address)
- Total contract amount
- Implementation period,\n including the date of delivery and operation date
- Detailed description of the\n nature of the project
- Applicant's role and function in relation to the completed\n work
- Size of the VAK (heat accumulation tank)
- If relevant, a description\n of other VAK (heat accumulation tank) constructed on the same site within the same\n timeframe/schedule

The references must only describe projects where the works\n were executed within the last ten years from the application deadline.
If more\n than three references are submitted, only the first three listed will be considered.\n
The time of execution is counted from the delivery deadline. The reference requirement\n can be fulfilled with references where the tenderer acted as a contractor or subcontractor.\n It is crucial is that the tenderer carried out the work covered by the reference.
References\n can be included as a separate appendix, and in such a case, the Contracting Authority\n encourages the appendix to be referenced in the ESPD. If there is a discrepancy between\n references listed in the ESPD and in an appendix, the ESPD shall prevail.

The\n Contracting Authority intends to prequalify five applicants who will be invited to\n submit an initial tender.
If there are more eligible, suitable applicants, the\n Contracting Authority will select the most suitable ones. Selection will be based\n on the references submitted.
