The term of the framework agreement may be extended up to 5 times by one\n (1) year. Due to Council Regulation (EU) 2022/576 of 8 April 2022, Article 5k, points (a)–(c),\n amending Regulation (EU) No. 833/2014 on restrictive measures in view of Russia’s\n actions destabilizing the situation in Ukraine, the contracting entity can and will\n not award the Framework Agreement to economic operators covered by the prohibition.
Companies\n covered by the prohibition include:
a) Russian nationals or natural or legal\n persons, entities, or bodies established in Russia;
b) Legal persons, entities,\n or bodies directly or indirectly owned for more than 50% by entities mentioned under\n (1); or
c) Natural or legal persons, entities, or bodies acting on behalf of or\n at the direction of an entity referred to under (1) or (2).
The prohibition\n also applies to subcontractors and supporting entities from or connected to Russia\n if the subcontractor’s or supporting entity’s contribution constitutes more than 10%\n of the contract value. Companies covered by the above exclusion grounds cannot submit\n a tender.
2. The tender documents are available, and applications and tenders\n must be uploaded via www.comdia.com.
The validity period for received tenders\n is 90 days.
The contracting authority reserves the right to award the Framework\n Agreement based on the initial tenders without negotiations.\n \n \n 5.1.9 UdvælgelseskriterierKilder til udvælgelseskriterier: Bekendtgørelse\n Kriterium: Specifik gennemsnitlig årlig omsætningBeskrivelse: The applicant must provide turnover figures for the past 3 years. It is a minimum\n requirement that the applicant has had a total annual turnover of at least six (6)\n million DKK in each of the three (3) most recent available financial years.
Under\n this section of the ESPD, the applicant must provide turnover figures for the three\n most recent available financial years.
If the applicant is a group of economic\n operators (e.g. a consortium), the turnover is calculated as the combined turnover\n of the participating economic operators.
If the applicant relies on the\n economic and financial capacity of other entities, the turnover is calculated as the\n combined turnover of the applicant and those entities. The supporting entities must,\n in this case, submit a letter of support.
If the applicant directly or indirectly\n holds ownership interests in the supporting entity, or vice versa, the turnover is\n calculated based on the consolidated financial statements of the companies. The same\n applies if one consortium participant directly or indirectly holds ownership interests\n in another consortium participant.
If the applicant relies on the economic\n and financial capacity of other entities, the applicant and those entities are jointly\n and severally liable for the performance of the contract, in accordance with section\n 144(6) of the Danish Procurement Act. The supporting entities must confirm this liability\n in their letter of support. The supporting entities must use the contracting entity's\n template for the letter of support.
For groups of economic operators (e.g.\n a consortium), the participating economic entities in the group are jointly and severally\n liable for fulfilling the tendered assignment. The participating economic operators\n must confirm this liability and use the contracting entity's template for the consortium\n declaration.\n \n Kriterium: Finansielt forholdBeskrivelse: The applicant must provide the solvency ratio for the past 3 years. It is a minimum\n requirement that the applicant has had a solvency ratio of at least 10% in each of\n the three (3) most recent available financial years.
Under this section of\n the ESPD, the applicant must provide the solvency ratio for the three most recent\n available financial years. In the description section, the applicant is also requested\n to state the Equity and Total assets of the applicant.
If the applicant is\n a group of economic operators (e.g. a consortium), the solvency ratio is calculated\n as the combined solvency ratio of the participating economic operators. Equity and\n Total assets should be stated for each member of the group of economic operators.\n
If the applicant relies on the economic and financial capacity of other\n entities, the solvency ratio is calculated as the combined solvency ratio of the applicant\n and those entities. Equity and Total assets should be stated as well for each entity.\n The supporting entities must, in this case, submit a letter of support.
If\n the applicant directly or indirectly holds ownership interests in the supporting entity,\n or vice versa, the solvency ratio is calculated based on the consolidated financial\n statements of the companies.
