Anden begrundelse: It is Ørsted’s assessment that the supplies and services can only be provided by Burmeister\n & Wain Energy ApS because of the protection of the exclusive rights, including intellectual\n property rights related to the original design and drawings, cf. Article 50(c)(iii)\n of the Utilities Directive.
Burmeister & Wain Energy ApS is the original equipment\n manufacturer and holds intellectual property rights to the relevant design and drawings\n for the steam headers, and Ørsted does not have access to it either. Manufacture of\n replacement headers to the original design, including the transition pieces and connection\n tubes requires access to and use of those protected drawings and design information.
Additionally,\n based on Ørsted’s market research, no other supplier is able to supply the outlet\n headers without spending substantial time studying the physical boiler design, which\n could also in itself violate Burmeister & Wain Energy ApS ’s rights. However, access\n restrictions apply in the boiler house above level 48 m due to the risk of high pressure\n steam leakage. Hot high pressure steam is inherently dangerous. These restrictions\n prevent normal maintenance work and inspection above level 48 m (the building height\n is approximately 90 m). Based on personal safety risk assessment, it is not permitted\n during operation to access the boiler areas where the steam headers are located. To\n access the steam headers, the boiler must be shut down for several days and cooled\n down, and insulation and steel casing around the steam headers must be removed, requiring\n an extended shutdown with substantial associated costs.
In addition, the replacement\n project is very urgent to minimize continued exposure to high pressure steam leakage\n risk and to avoid extended shutdown periods.
Accordingly, it is not in practice\n possible for other suppliers to study the physical boiler design and learn how to\n design the outlet headers, as using an alternative supplier would require re-engineering\n and/or redesign and qualification of an equivalent component, which would extend the\n schedule and increase risk and outage duration, resulting in an extended shutdown\n with substantial associated costs. Thus, Ørsted must award the contract to the supplier\n that holds the intellectual property rights to the design.
