It is therefore not possible\n for a third party to perform the intended upgrades to the existing signalling system,\n as the GoA4 upgrades and the related new hardware in the form of infrastructure changes\n must be able to be integrated into the current signalling system, which is why only\n the existing supplier can provide the necessary upgrades. This has also been confirmed\n by a written market dialogue held by DSB with consent from Banedanmark. In the market\n dialogue, which ended on 12 October 2023, the market was asked whether it could deliver\n the upgrade to GoA4 to the existing system. 38 suppliers saw the invitation to dialogue\n and 4 responded. None of the 4 suppliers responded that they could deliver the necessary\n upgrade to the existing system. Furthermore, in relation to railway safety the signalling\n system is a safety critical system with a single safety certification which on a system\n level makes it necessary for upgrades to be delivered by the same supplier that has\n delivered and certified the entire signalling system. If someone other than the current\n supplier was to provide the upgrades to the signalling system, this would mean that\n the entire current signalling system would need to be replaced, as the upgrades cannot\n be separated, delivered and certified separately by another supplier. This also means\n that the GoA4 development tasks covered by these changes can only be carried out by\n the same supplier who has delivered the entire signalling system, as this requires\n an insight into the system that is only possessed by the current supplier, and the\n current supplier has a number of exclusive intellectual property rights to the system,\n its sub-systems, components and software, that are necessary to be able to deliver\n upgrades to, and continue operations of, the system. Siemens is thus regarding these\n changes the only supplier who, due to technical reasons, can provide the services\n covered by the procurement, and the procurement may thus be carried out without a\n tender process on the basis of Article 50(c)(ii) of the Utilities Directive and partly\n due to the protection of exclusive rights, including intellectual property rights,\n cf. Consequently, Banedanmark and DSB hereby announces their intention to enter into an agreement to amend the previously tendered CBTC contract.\nBanedanmark and DSB thus needs to make changes to the CBTC contract in order to implement the upgrade to a GoA4 system.\nSpecifically, the changes relate to 1) development tasks in relation to the implementation of GoA4 (driverless operation), which includes software updates and calibration to implement GoA4 functions, including in relation to the control system, security systems and internal and external interfaces, including to enable the operation of a mixed GoA2 and GoA4 fleet of S-trains during a transition period, 2) software changes regarding changes to the configurations of stations to adapt to the new S-trains necessary for the implementation of the new driverless trains, 3) infrastructure changes regarding the movement and supply of new balises, 4) installation of axel counters and airlink radios, 5) supply, test and commissioning of axel counters, test track equipment and airlink radios, 6) updating documentation, training material etc., 7) installation, testing and commissioning regarding the software updates, 8) test and commissioning of the onboard equipment in the first 20 new S-trains, 9) test and commissioning of onboard equipment in trainset 21 and onwards including commissioning manuals and training, 10) assistance in obtaining the necessary safety approvals of the CBTC signalling system, 11) enhancement to the current maintenance services for the upgraded signalling system for 276 months, 12) DSB becoming a party to the part of the contract covering the GoA4 upgrade (the changes mentioned) alongside BDK and 13) a number of changes to the contractual terms and conditions of the existing contract which will only be applicable to the GoA4 upgrade. These changes include changes to clauses regarding the context in which the GoA4 upgrade will take place (primarily update to background, phases, scope, customer's environment and participation etc.). The changes also include adjusted responsibility for safety approval of GoA4, reliability demonstration tests and targets, commissioning and final acceptance.
