2.1 Procedure

Titel: Copenhagen - New Metroline, M5 Transportation System

Beskrivelse: This tender presents a substantial opportunity for prospective contractors to bid\n for the M5 Transportation System South package (TSS), a critical component of the\n Copenhagen metro system's expansion. This project is of significant strategic importance,\n as the M5 line is a fully automated driverless metro system that will not only enhance\n passenger service on existing metro corridors but is also planned to extend connectivity\n to emerging urban development areas, including Kløverparken, Refshaleøen, and Lynetteholm\n in the East Harbour. The M5 is to operate as an independent system, ensuring that\n its construction and subsequent operation do not disrupt the existing M1-M4 metro\n lines.
The current tender, Phase 1, encompasses the southern section of the line,\n from København H to north of v/Prags Boulevard, with an anticipated operational commencement\n in 2036. The broader vision includes the northern section with an anticipated operatonal\n commencement of the last part of the northern section in 2045 (included in the transportation\n system contract (TSS-contract) as options) and a potential future extension to form\n a ring line, signifying a long-term commitment to urban mobility.
The procurement\n comprises the following, together constituting a mixed procurement within the meaning\n of Article 5 (2) of the Utilities Directive:
1) A TRANSPORTATION SYSTEM for M5\n south encompassing the subsystems rolling stock (passenger vehicles, service vehicles\n and rescue trolleys), railway infrastructure (signaling system and other subsystems,\n excluding permanent way and power supply \"on the line\"), and a CMC (control and maintenance\n center). Furthermore, O&M supplies (supplies related to the O&M providers operation\n and maintenance activities such as maintenance plans and training). “On the line”\n refers to deliveries outside the CMC (as the Transportation System Contractor (TSC)\n is itself responsible for power supply and permanent way within the CMC). The integration\n of the mentioned TS-subsystems and the integration of the scope of supply of the CWC\n into the Transportation System (including but not limited to permanent way and power\n supply on the line) is also part of the TSC's responsibilities and forms part of the\n TSS-contract. Rolling stock, railway Infrastructure and the CMC are further described\n in M5-2-TSS-SW (Scope of Work) of the tender documents.
2) MAINTENANCE SERVICES\n following hand over of the Transportation System related to the continued maintenance\n of the Transportation System (hereinafter Maintenance Services).
The TSS-contract\n covers both the Transportation System and the Maintenance Services. The Maintenance\n Services are governed by a separate maintenance contract forming an attachment to\n the TSS-contract (hereinafter Maintenance Contract) The purchase of the Transportation\n System and the Maintenance Services should therefore be seen as a whole and only one\n Tenderer will be awarded the contracts. The expected scope and characteristics of\n the two contracts are described in the tender documents.
3) OPTIONS
Three\n (3) options are included in the TSS-contract:
Option 1: The purchase of up to\n 5 additional passenger vehicles.
Option 2: The extension of the transportation\n system from Prags Boulevard to Refshaleøen.
Option 3: The extension of the transportation\n system from Refshaleøen to Lynetteholm.
Metroselskabet’s requirements relating\n to the Transportation System are set out in the tender documents, including the draft\n TSS-contract and the Scope of Works document (M5-2-TSS-SW). Requirements may be developed\n and changed during the competitive dialogue.
As regards the Maintenance Contract,\n no draft contract or draft specifications are included in the tender documents at\n this stage. This reflects the fact that a central element of the competitive dialogue\n will be to explore the scope and structure of the Maintenance Contract, including\n the distribution of maintenance tasks between the TSCand the future operator of the\n Transportation System (hereinafter the OAMC). As a central element of the dialogue\n phase, Metroselskabet wishes to explore the advantages and implications of possible\n distributions of maintenance tasks between the TSC and the OAMC and the technical,\n commercial and legal terms that will be relevant depending on the maintenance model\n chosen. The potential models to be discussed and assessed during the dialogue phase\n are expected to span from a scope of the Maintenance Contract similar to TSSSA models\n (“Technical Support and Spares Supply Agreements”) to a scope similar to FSA models\n (“Full Service Agreements”) whereby the Metroselskabet would procure most goods, works\n and services needed for the maintenance and continued development of the Transportation\n System from the TSC. However, also models which are “in between” or a model where\n the scope will change over time may be chosen. Also the options to purchase additional\n passenger vehicles and options covering the extension of the line (northern section)\n are subject to dialogue. Both technical and commercial requirements are expected to\n be discussed including elements related to pricing. For further detailing of items\n planned to be subject for dialogue, reference is made to the Instructions to Tenderers\n (M5-0-TSS-ITT).

SELECTION AMONG SUITABLE\n APPLICANTS (SELECTION CRITERION):
The following describes the selection criterion\n and is divided into three headings (1-3), with headings highlighted in capitals.
1.\n SELECTION OF THREE TO FOUR (3-4) APPLICANTS: Among the applicants who (i) are not\n subject to any of the grounds for exclusion set out in section 2.1.6 below and (ii)\n satisfy the minimum requirements for economic and financial capacity and technical\n and professional capacity set out in this notice (\"suitable applicants”), Metroselskabet\n will select not fewer than three (3) and not more than four (4) suitable applicants\n to be invited to participate in the dialogue phase and the tender phase (\"selected\n applicants\"). The selection shall be carried out on the basis of the selection criterion\n set out below in section “2. SELECTION CRITERION – ASSESSMENT OF THE MOST COMPETITIVE\n FIELD OF TENDERERS” and in accordance with the procedure set out in section “3. SELECTION\n OF THREE OR FOUR (3 OR 4) APPLICANTS”. For the avoidance of doubt, the specified range\n of three to four (3-4) applicants entails that Metroselskabet is obliged to select\n a minimum of three (3) (provided three (3) suitable applicants can be identified)\n and is entitled to select a maximum of four (4) suitable applicants. The determination\n of the precise number of applicants to be selected within this range shall be made\n in accordance with the procedure set out below.
2. SELECTION CRITERION – ASSESSMENT\n OF THE MOST COMPETITIVE FIELD OF TENDERERS:
The selection will be made on the\n basis of an assessment of which three (3) or four (4) suitable applicants provide\n the most competitive field of tenderers, taking into account the applicants' experience\n within the two categories (Category 1 and Category 2) set out below. In defining the\n two categories and in selecting applicants within those categories, Metroselskabet\n has aimed to ensure the greatest possible competition for the contract by selecting\n both (i) applicants with experience from projects that, assessed across the greatest\n number of parameters, are as comparable as possible to the tendered contract, and\n (ii) applicants whose experience, while less broadly comparable, demonstrates a high\n degree of comparability in respect of certain defined parameters considered indicative\n of the tendered contract being of particular interest to those applicants by virtue\n of their experience within these specific areas. Metroselskabet considers that this\n approach ensures the selection of a group of applicants which, taken together, provides\n the highest possible level of competition for the contract, thereby ensuring the most\n competitive field of tenderers. Section “2.1. CATEGORY 1” and section “2.2. CATEGORY\n 2” in this notice set out the two categories (Category 1 and Category 2) and describe\n the parameters to which Metroselskabet will attach importance when assessing the applicants’\n experience within each category. Section “3. SELECTION OF THREE OR FOUR (3 OR 4) APPLICANTS”\n below sets out the procedure for determining whether three (3) or four (4) suitable\n applicants shall be selected in order to ensure the most competitive field of tenderers.
2.1.\n CATEGORY 1: In Category 1, emphasis will be placed on selecting applicants who, through\n their references, demonstrate the highest level of experience with the following types\n of projects, referred to as Category 1a and Category 1b. Category (1a): Integrated\n delivery of metro signaling system and rolling stock in a single contract. Category\n 1a comprises projects involving design, installation, commissioning, testing and handover\n of a metro signaling system, including sub-systems, and rolling stock, delivered within\n a single contract. Projects involving \"GoA4 CBTC signaling systems\" will be considered\n particularly relevant in the assessment of the applicant’s experience with Category\n 1a projects. By “rolling stock” is meant passenger vehicles for metros, as defined\n below regarding the minimum requirement for technical and professional capacity. By\n “GoA4 CBTC signaling systems” is meant communications-based train control. Category\n (1b): Design and construction of a Control and Maintenance Centre or a comparable\n building. Category 1b comprises projects involving design and construction of a Control\n and Maintenance Centre or a comparable industrial or operational building characterised\n by critical operational functions, heavy technical infrastructure (such as redundant\n power supply, cooling systems, and advanced control and monitoring systems), and heightened\n requirements for security. Projects involving the design and construction of such\n a building, carried out according to Danish Building Regulations (BR18, Executive\n Order No. 1615 of 13 Dec. 2017) or similar, will be considered particularly relevant\n in the assessment of the applicant's experience with Category 1b projects. In the\n selection of applicants under Category 1, sub-criteria 1a and 1b will be accorded\n equal weight.
2.2. CATEGORY 2: In Category 2, emphasis will be placed on selecting\n applicants who, through their references, demonstrate the highest level of experience\n with the following types of projects, referred to as Category 2a and Category 2b.\n Category (2a): Planning, design, production, commissioning, testing and handover of\n uniquely designed passenger vehicles for metro systems in small batches. Category\n 2a comprises projects involving planning, design, production, commissioning, testing\n and handover of uniquely designed passenger vehicles for metro systems, delivered\n in small batches. “Passenger vehicles” corresponds to the definition of “rolling stock”\n as set out below regarding the minimum requirement for technical and professional\n capacity. By \"uniquely designed\" is meant passenger vehicles specifically designed\n for a particular project and client, as opposed to standard off-the-shelf vehicles.\n By \"small batches\" is meant a first delivery of a limited number of vehicles, in the\n range of ten (10) to thirty (30) vehicles, under a single contract, without any guarantee\n of further orders. Category (2b): Integration of transportation systems for metro\n systems, including rolling stock. Category 2b comprises projects involving the integration\n of transportation systems for metro systems, including rolling stock. Projects involving\n (i) design and construction of a Control and Maintenance Centre or a comparable industrial\n or operational building characterised by critical operational functions, heavy technical\n infrastructure (such as redundant power supply, cooling systems, and advanced control\n and monitoring systems), and heightened requirements for security, and (ii) the design\n and construction of such a building, carried out according to Danish Building Regulations\n (BR18, Executive Order No. 1615 of 13 Dec. 2017) or similar will be considered particularly\n relevant in the assessment of the applicant's experience with Category 2b projects.\n By “integration of transportation systems” is meant the coordination and interfacing\n of multiple subsystems, including rolling stock, infrastructure, signaling and control\n systems, to ensure their functional and operational compatibility as a unified system.\n By “rolling stock” is meant passenger vehicles for metros, as defined below regarding\n the minimum requirement for technical and professional capacity. In the selection\n of applicants under Category 2, sub-criteria 2a and 2b will be accorded equal weight.\n
3. SELECTION OF THREE OR FOUR (3 OR 4) APPLICANTS:
The determination of the\n most competitive field of tenderers, including whether three (3) or four (4) suitable\n applicants shall be invited to participate in the dialogue phase and the tender phase,\n shall be made in accordance with the following procedure. Two (2) applicants shall\n be selected within each of Category 1 and Category 2, provided that at least two (2)\n suitable applicants can be identified in each category. For the avoidance of doubt,\n no overall ranking of applicants shall be made across Category 1 and Category 2. The\n assessment of applicants within each category shall be carried out independently of\n the assessment within the other category. Where more than two (2) suitable applicants\n within a category have submitted references for projects falling within that category,\n Metroselskabet shall select the two (2) applicants demonstrating the most relevant\n experience within the category concerned. Where at least two (2) suitable applicants\n can be identified in Category 1 but only one (1) in Category 2, or vice versa, Metroselskabet\n shall select three (3) applicants in total, comprising two (2) from the category in\n which at least two (2) suitable applicants have been identified and one (1) from the\n other category. A selection of three (3) applicants distributed in this manner is\n considered to ensure a more competitive field of tenderers than a selection of four\n (4) applicants comprising three (3) from one category and one (1) from the other,\n having regard to the differences in the applicants’ experience profiles and corresponding\n competencies. Where only three (3) suitable applicants are identified in total, and\n all such applicants have submitted references exclusively within one category, all\n three (3) applicants shall be selected.
