2.1 Procedure

Titel: Tender Procedure concerning the supply of Big Boxes, Lids and Feet

Beskrivelse: DRS is obligated to collect deposited Beverage Packaging from Customers having subscribed\n with DRS. DRS uses the Big Boxes for collection at the individual Customers of intact\n compacted Beverage Packaging’ consisting exclusively of compacted aluminium cans and\n compacted one-way plastic bottles. The Beverage Packaging’ are collected from the\n Customers in the Big Boxes, which are placed either directly on the floor in the bottle\n room or in other back premises, including outdoor, before collection. DRS uses other\n types of transport equipment for the collection of Beverage Packaging. It is thus\n important that it is possible to stack the Big Boxes by using DRS’s existing transport\n equipment.

The Contract will be carried out in period 1 January 2027 – 31\n December 2030. DRS may place an order on the final day of the Contract Term, to be\n delivered in accordance with the Contract.

DRS guarantees ordering a total\n of 20,000 Big Boxes and 60,000 Lids during the Contract Term.

The guaranteed\n quantity may be divided into separate orders and successive deliveries in accordance\n with the draft Contract.

Delivery must be made to one of the following addresses:\n
- Bundgårdsvej 6, 7000 Fredericia, Denmark
- Jellingvej 16, 9230 Svenstrup,\n Denmark
- Bredebjergvej 10, 2630 Taastrup, Denmark.

Upon conclusion\n of the Contract, DRS will place an initial order for 5,000 Big Boxes and 15,000 Lids\n for successive delivery commencing in March/April 2027.

At\n the same time DRS will ask the Tenderers to submit a declaration regarding Council\n Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view\n of Russia’s actions destabilizing the situation in Ukraine, pursuant to which DRS\n may not award a Contract to the following:

- Russian nationals, natural persons\n resident in Russia, or legal persons, entities or bodies established in Russia,
-\n legal persons, entities or bodies in which an entity covered by point (a) directly\n or indirectly holds more than 50 %, or

If the contracting\n authority receives a complaint in connection with the tender, the expiry of the commitment\n period shall be temporarily suspended for the period during which the complaint has\n suspensive effect. Tenderers shall be released from their commitment at the end of\n the commitment period, upon notification by the contracting authority of the cancellation\n of the tender procedure, or at the time the contracting authority publishes a notice\n of the conclusion of the contract (but not upon the contracting authority’s notification\n of the award of the contract).

Documentation relating\n to grounds for exclusion must not have been issued more than six months prior to the\n expiry of the tender deadline.

As evidence of their economic and financial\n standing, a Tenderer may submit annual accounts or extracts therefrom. If this is\n not possible, or if the relevant information is not apparent therefrom, the Tenderer\n may submit relevant statements from an auditor or equivalent, as well as any other\n document which DRS deems appropriate.

The Tenderer is not required to submit\n documentation of its technical and professional capacity; however, DRS may request\n such documentation.
DRS may request a tenderer to enclose translations of the\n documentation if the documents in question are not available in Danish or English.

At\n the same time DRS will ask the Tenderers to submit a declaration regarding Council\n Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view\n of Russia’s actions destabilizing the situation in Ukraine, pursuant to which DRS\n may not award a Contract to the following:

- Russian nationals, natural persons\n resident in Russia, or legal persons, entities or bodies established in Russia,
-\n legal persons, entities or bodies in which an entity covered by point (a) directly\n or indirectly holds more than 50 %, or
- natural or legal persons, entities or\n bodies acting on behalf of or on the instructions of an entity referred to in point\n (a) or (b),

including, where they account for more than 10 per cent of the\n value of the Contract, subcontractors, suppliers or entities whose capacity is utilized,\n as set out in Part II.C of the ESPD.

Tenderers are advised to use Annex 4,\n which forms part of the Tender documentation.

The tenderer must maintain\n its tender for 3 months from the expiry of the tender deadline.

If the contracting\n authority receives a complaint in connection with the tender, the expiry of the commitment\n period shall be temporarily suspended for the period during which the complaint has\n suspensive effect. Tenderers shall be released from their commitment at the end of\n the commitment period, upon notification by the contracting authority of the cancellation\n of the tender procedure, or at the time the contracting authority publishes a notice\n of the conclusion of the contract (but not upon the contracting authority’s notification\n of the award of the contract).

Fraud: Has the economic operator itself or any person who is a member of its administrative,\n management or supervisory body or has powers of representation, decision or control\n therein been the subject of a conviction by final judgment for fraud, by a conviction\n rendered at the most five years ago or in which an exclusion period set out directly\n in the conviction continues to be applicable? Within the meaning of Article 1 of the\n Convention on the protection of the European Communities' financial interests (OJ\n C 316, 27.11.1995, p. 48).

Money laundering or terrorist financing: Has the economic operator itself or any person who is a member of its administrative,\n management or supervisory body or has powers of representation, decision or control\n therein been the subject of a conviction by final judgment for money laundering or\n terrorist financing, by a conviction rendered at the most five years ago or in which\n an exclusion period set out directly in the conviction continues to be applicable?\n As defined in Article 1 of Directive 2005/60/EC of the European Parliament and of\n the Council of 26 October 2005 on the prevention of the use of the financial system\n for the purpose of money laundering and terrorist financing (OJ L 309, 25.11.2005,\n p. 15).

Participation in a criminal organisation: Has the economic operator itself or any person who is a member of its administrative,\n management or supervisory body or has powers of representation, decision or control\n therein been the subject of a conviction by final judgment for participation in a\n criminal organisation, by a conviction rendered at the most five years ago or in which\n an exclusion period set out directly in the conviction continues to be applicable?\n As defined in Article 2 of Council Framework Decision 2008/841/JHA of 24 October 2008\n on the fight against organised crime (OJ L 300, 11.11.2008, p. 42).

Terrorist offences or offences linked to terrorist activities: Has the economic operator itself or any person who is a member of its administrative,\n management or supervisory body or has powers of representation, decision or control\n therein been the subject of a conviction by final judgment for terrorist offences\n or offences linked to terrorist activities, by a conviction rendered at the most five\n years ago or in which an exclusion period set out directly in the conviction continues\n to be applicable? As defined in Articles 1 and 3 of Council Framework Decision of\n 13 June 2002 on combating terrorism (OJ L 164, 22.6.2002, p. 3). This exclusion ground\n also includes inciting or aiding or abetting or attempting to commit an offence, as\n referred to in Article 4 of that Framework Decision.

Child labour and including other forms of trafficking in human beings: Has the economic operator itself or any person who is a member of its administrative,\n management or supervisory body or has powers of representation, decision or control\n therein been the subject of a conviction by final judgment for child labour and other\n forms of trafficking in human beings, by a conviction rendered at the most five years\n ago or in which an exclusion period set out directly in the conviction continues to\n be applicable? As defined in Article 2 of Directive 2011/36/EU of the European Parliament\n and of the Council of 5 April 2011 on preventing and combating trafficking in human\n beings and protecting its victims, and replacing Council Framework Decision 2002/629/JHA\n (OJ L 101, 15.4.2011, p. 1).

Breaching of obligations in the fields of environmental law: Has the economic operator, to its knowledge, breached its obligations in the field\n of environmental law?
