During the coming years, Sønderborg Varme’s entire district\n heating system is under reconstruction, partly due to the connection of new customers and partly\n due to new roles for the existing district heating capacities, where also decommissioning\n of existing technologies may become relevant. In the ongoing restructuring of the district\n heating network, heat pumps will play a vital role. The first heat pump shall be installed in Gråsten. The Applicant must confirm that the Applicant is not covered\n by the mandatory exclu-sion grounds laid down in Section 134 a. (1-2), Section 135(1)-(6)\n and Section 136 of the Danish Public Procurement Act. Otherwise, Sønderborg Varme\n A/S is obliged to exclude the Applicant.
The Applicant must further confirm that\n the Applicant is not covered by optional exclusion grounds laid down in Section 137\n (1)-(5) of the Danish Public Procurement Act.
If the Application is submitted\n by a group of undertakings (e.g., a Consortium), the Applicant is encouraged to sign\n the Consortium Declaration in the form of Annex B - Consortium Declaration and to\n submit it together with the Application.
If the Applicant is a consortium;
a)\n the members of the Consortium shall be jointly and severally liable to the Contracting\n Entity for the performance of the Consortiums’ obligations under of the Contract;\n and
b) neither the members nor (if known) the scope and parts of the Contract\n to be carried out by each member nor the legal status of the Consortium shall be altered\n without the prior consent of the Contracting Entity.
Sønderborg Varme A/S\n reserves the right to request an applicant/tenderer to provide documentation for the\n information at any stage of the tender process if this is necessary to ensure that\n the procedure is carried out correctly. For Danish tenderers, documentation may, for\n example, consist of a serial certificate issued by the Danish Business Authority.
Due\n to Council Regulation (EU) 2022/576 of 8 April 2022 amending Regulation (EU) No 833/2014\n concerning restrictive measures in view of Russia’s actions destabiliz-ing the situation\n in Ukraine, the Contracting Entity can and will not award the Contract to a tenderer\n with certain relations to Russia. The prohibited relations to Russia are further outlined\n in Annex D - Declaration regarding relations to Russia.
Therefore, the Applicant\n is encouraged to sign the Declaration regarding relations to Russia in the form of\n Annex D - Declaration regarding relations to Russia and to submit it together with\n the Application.
Before the Contract is awarded, the Contracting Entity will\n require that the tenderer who has submitted the most economically advantageous tender\n based on the criteria set out in the Tender Procedure declares that the tenderer does\n not have relations to Russia that are prohibited according to Council Regulation (EU)\n 2022/576.
I henhold til lov om Klagenævnet for Udbud gælder følgende frister\n for indgivelse af klage:
Klage over ikke at være blevet prækvalificeret skal\n være indgivet til Klagenævnet for Udbud inden 20 kalenderdage fra dagen efter afsendelse\n af en underretning til de berørte ansøgere om, hvem der er blevet udvalgt, jf. udbudslovens\n § 171, stk. 2, eller klagenævnslovens § 2, stk. 1, nr. 1, når underretningen er ledsaget\n af en begrundelse for beslutningen.
I andre situationer skal klage over udbud\n være indgivet til Klagenævnet for Udbud inden:
1. 45 kalenderdage efter,\n at ordregiveren har offentliggjort en bekendtgørelse i Den Europæiske Unions Tidende\n om, at ordregiveren har indgået en kontrakt. Fristen regnes fra dagen efter den dag,\n hvor bekendtgørelsen er blevet offentliggjort.
2. 30 kalenderdage regnet fra dagen\n efter den dag, hvor ordregiveren har underrettet de berørte tilbudsgivere om, at en\n kontrakt baseret på en rammeaftale med genåbning af konkurrencen eller et dynamisk\n indkøbssystem er indgået, hvis underretningen har angivet en begrundelse for beslutningen.
3.\n seks måneder efter, at ordregiveren har indgået en rammeaftale regnet fra dagen efter\n den dag, hvor ordregiveren har underrettet de berørte ansøgere og tilbudsgivere, jf.\n klagenævnslovens § 2, stk. 2, eller udbudslovens § 171, stk. 4.
4. 20 kalenderdage\n regnet fra dagen efter, ordregiveren har meddelt sin
beslutning, jf. udbudslovens\n § 185, stk. 2.
Senest samtidig med, at en klage indgives til Klagenævnet\n for Udbud, skal klageren skriftligt underrette ordregiveren om, at klage indgives\n til Klagenævnet for Udbud, og om, hvorvidt klagen er indgivet i standstill-perioden,\n jf. klagenævnslovens § 6, stk. 4. I tilfælde, hvor klagen ikke er indgivet i standstill-perioden,\n skal klageren tillige angive, hvorvidt der begæres opsættende virkning af klagen,\n jf. klagenævnslovens § 12, stk.
The contracting authority is entitled,\n but not obliged, to request the tenderer, the association’s participants or other\n entities to supplement or specify the received documentation, see the Utilities Directive\n art. 76 (4).
If the tenderer, the association’s participants or other entities\n are from Denmark, the documentation is presented in the form of a service certificate\n from the Danish Business Authority. The service certificate must contain information\n from:
— the probate court under the Danish District courts,
— the Danish Customs\n and Tax Administration,
— the Danish Labour Market Supplementary Pension Fund\n (ATP),
— the Police (the Danish Central Crime Register) Please note that a ‘declaration\n of consent’ must be filled in,signed and uploaded when ordering the service certificate.
The\n service certificate must be maximum six (6) months old calculated from the deadline\n for submission of the service certificate as stated by the contracting authority in\n the letter of request.
The processing time with the Danish business authority\n is approximately 2 weeks from when the order of the service certificate has been received.
If\n the tenderer, one or more of the participants in the association or other entities\n are not from Denmark, they must, as a general rule, submit the types of documentation\n stipulated in eCertis. eCertis is an online information system which must be used\n to find the right documentation to be used by EU member states in connection with\n invitations to tender.

The Applicant must confirm that the Applicant is not covered\n by the mandatory exclu-sion grounds laid down in Section 134 a. (1-2), Section 135(1)-(6)\n and Section 136 of the Danish Public Procurement Act. Otherwise, Sønderborg Varme\n A/S is obliged to exclude the Applicant.
The Applicant must further confirm that\n the Applicant is not covered by optional exclusion grounds laid down in Section 137\n (1)-(5) of the Danish Public Procurement Act.
If the Application is submitted\n by a group of undertakings (e.g., a Consortium), the Applicant is encouraged to sign\n the Consortium Declaration in the form of Annex B - Consortium Declaration and to\n submit it together with the Application.
If the Applicant is a consortium;
a)\n the members of the Consortium shall be jointly and severally liable to the Contracting\n Entity for the performance of the Consortiums’ obligations under of the Contract;\n and
b) neither the members nor (if known) the scope and parts of the Contract\n to be carried out by each member nor the legal status of the Consortium shall be altered\n without the prior consent of the Contracting Entity.
Sønderborg Varme A/S\n reserves the right to request an applicant/tenderer to provide documentation for the\n information at any stage of the tender process if this is necessary to ensure that\n the procedure is carried out correctly. For Danish tenderers, documentation may, for\n example, consist of a serial certificate issued by the Danish Business Authority.
Due\n to Council Regulation (EU) 2022/576 of 8 April 2022 amending Regulation (EU) No 833/2014\n concerning restrictive measures in view of Russia’s actions destabiliz-ing the situation\n in Ukraine, the Contracting Entity can and will not award the Contract to a tenderer\n with certain relations to Russia. The prohibited relations to Russia are further outlined\n in Annex D - Declaration regarding relations to Russia.
Therefore, the Applicant\n is encouraged to sign the Declaration regarding relations to Russia in the form of\n Annex D - Declaration regarding relations to Russia and to submit it together with\n the Application.
Before the Contract is awarded, the Contracting Entity will\n require that the tenderer who has submitted the most economically advantageous tender\n based on the criteria set out in the Tender Procedure declares that the tenderer does\n not have relations to Russia that are prohibited according to Council Regulation (EU)\n 2022/576.

The contracting authority is entitled,\n but not obliged, to request the tenderer, the association’s participants or other\n entities to supplement or specify the received documentation, see the Utilities Directive\n art. 76 (4).
If the tenderer, the association’s participants or other entities\n are from Denmark, the documentation is presented in the form of a service certificate\n from the Danish Business Authority. The service certificate must contain information\n from:
— the probate court under the Danish District courts,
— the Danish Customs\n and Tax Administration,
— the Danish Labour Market Supplementary Pension Fund\n (ATP),

The Applicant is encouraged\n to provide the following information about the Applicant’s completed experience with\n heat pumps and industrial buildings in part V of the eESPD. The experience will be\n based on already completed parts of the ongoing experience.
A maximum of\n five (5) references can be submitted as information under the selection criterion\n “Experience”. If more references are submitted, only the most recent references up\n to the maximum number of references will be considered. The most recent references\n will be determined based on start date.
No additional documentation for the\n selection criterion for experience will be required from the Applicant. However, the\n Contracting Entity reserves the right to contact the Applicant or relevant third parties\n for verification of the information stated in the description(s).
Please\n submit information about the Applicant's experience from the last five (5) years to\n the Prequalification Deadline, and which the Applicant has completed within such period\n (i.e. the execution end date of the reference must be within this period). The Applicant\n is encouraged to describe the following for each reference in part V of the eESPD\n or with clear references e.g. by using Annex A:
a) Name of project and country
b)\n Name of employer incl. contact person and telephone number
c) Period of execution\n start date (Month/Year) and end date (Month/Year)

The\n Applicant’s experience will be based on the information submitted will be an overall\n assessment of the references (the Applicant’s experience). Taking into account both\n the relevance of each reference as well as the number of relevant references. A reference\n will be evaluated positively the more relevant the reference is considered to be.\n The more of the following elements that are contained in the reference the more relevant:
(a)\n Similarity to the Contract, including the following elements;
Design, installation,\n commissioning and testing of large heat pump system
The size of the reference\n heat pump is comparable
The heat pump has an air-based heat collector/evaporator

Industrial buildings for\n district heating or energy production
Construction pits (including sheet piling,\n bracing and groundwater management) and pile foundations.
Construction of site\n development, soil, drainage, paving and fencing works.
The Applicant\n must fulfil the following minimum requirement regarding experience:

In the assessment of the sub-criterion, the Contracting\n Entity will regard the following as positive;
a) That provided information demonstrate\n the heat pump’s conceptual design is sound and robust for low winter ambient air temperature\n and/or high DH return temperature operation; it has short startup/shutdown time, cold\n plug flow through battery limit A is avoided, that system availability and component\n redundancy are properly considered, and it delivers high load-following capability\n including compressor start/stop without compromising longterm compo-nent reliability\n (i.e., low failure risk and minimal maintenance); the overall processsystem architecture\n remains simple, facilitating easy access, easy maintenance and flexible component\n placement. The more detailed infor-mation provided, the better.
b) That explanations\n are provided to the heat collector conceptual design and its interface with the heat\n pump(s), including the rationale for choosing refrigerant or brine in the collector\n circuit; thorough descriptions of how the circulation cir-cuit is designed to avoid\n unintended flow regimes, such as slug flow, that could violate piping safety etc.\n as well as proper dynamic performance, circulation rates for refrigerant-based systems,\n piping diagrams. The more detailed, the better.
c) That it, based on analyses\n and thorough explanations, is demonstrated that the energy collector system is robust\n to complex and varying in-/outflow of air, air short-circuiting, icing of surroundings\n is reduced, etc.
d) That the Tenderer provides a thorough management strategy\n to condensate, frost-prevention and de-icing, with appropriate icing/de-icing duration\n curves, with details to robustness of FCUs to icing and vibration. The more detailed\n informaton, the better.
e) That safety and environmental compliance measures are\n explained, including preliminary strategies to refrigerant leakage and detection,\n safety classification (such as e.g., ATEX) of the Contracting Entity’s site, emergency-venting\n provisions, and noise issues including from safety valves. The more detailed, the\n better.
f) That the Tenderer’s quality and inspection plan demonstrates a thorough\n understanding of the Contract’s quality and inspection requirements and is designed\n to ensure the facility immediately meets the agreed specifications and is fully functional\n upon delivery and commissioning. It will be evaluated posi-tive, if the plan include\n provisions for Factory Acceptance Testing (FAT), and the more detailed and comprehensive\n FAT procedures will be evaluated positively. The more detailed, the better.
The\n Contracting Entity will make an overall evaluation under this sub-criterion.
Project\n solution; Process- and Time schedule, Organiza-tion, culture and competences:
In\n the assessment of the sub-criterion, the Contracting Entity will regard the following\n as positive;
a. A process- and time schedule showing a detailed program and test,\n which appears responsible and well described. Furthermore, a plan that supports the\n fastest possible delivery and supports a high degree of quality man-agement during\n the delivery and test phases,
b. The more detailed, project specific (and relevant),\n coherent, and designed for continuous implementation the management and lessons learned\n procedures are, the better. It is also considered positive if the proposal includes\n examples from previous projects and how this is applied to this project, and
c.\n If each CV has a competent profile with experience, qualifications, training and competences\n in relation to the project and in relation to the assigned role in the team, and.\n The Contracting Entity will pay particular attention to the key persons performing\n the following roles and tasks:
i. The Tenderer's project managers (primary contact\n persons for the Contracting Entity).
ii. Overall responsibility for process design\n carried out by the Tenderer or its subcontractors/suppliers.
iii. Overall responsibility\n for civil works carried out by the Tenderer or its subcontractors/suppliers.
iv.\n The Tenderer's construction management.
The Contracting Entity will make an overall\n evaluation under this sub-criterion.
Evaluation of Contractual Terms:

Complaints about not being\n prequalified must be submitted to the Complaints Board for Public Procurement within\n 20 calendar days. The Applicant must confirm that the Applicant is not covered\n by the mandatory exclu-sion grounds laid down in Section 134 a. (1-2), Section 135(1)-(6)\n and Section 136 of the Danish Public Procurement Act. Otherwise, Sønderborg Varme\n A/S is obliged to exclude the Applicant.
The Applicant must further confirm that\n the Applicant is not covered by optional exclusion grounds laid down in Section 137\n (1)-(5) of the Danish Public Procurement Act.
If the Application is submitted\n by a group of undertakings (e.g., a Consortium), the Applicant is encouraged to sign\n the Consortium Declaration in the form of Annex B - Consortium Declaration and to\n submit it together with the Application.
If the Applicant is a consortium;
a)\n the members of the Consortium shall be jointly and severally liable to the Contracting\n Entity for the performance of the Consortiums’ obligations under of the Contract;\n and

Sønderborg Varme A/S\n reserves the right to request an applicant/tenderer to provide documentation for the\n information at any stage of the tender process if this is necessary to ensure that\n the procedure is carried out correctly. For Danish tenderers, documentation may, for\n example, consist of a serial certificate issued by the Danish Business Authority.
Due\n to Council Regulation (EU) 2022/576 of 8 April 2022 amending Regulation (EU) No 833/2014\n concerning restrictive measures in view of Russia’s actions destabiliz-ing the situation\n in Ukraine, the Contracting Entity can and will not award the Contract to a tenderer\n with certain relations to Russia. The prohibited relations to Russia are further outlined\n in Annex D - Declaration regarding relations to Russia.
Therefore, the Applicant\n is encouraged to sign the Declaration regarding relations to Russia in the form of\n Annex D - Declaration regarding relations to Russia and to submit it together with\n the Application.
Before the Contract is awarded, the Contracting Entity will\n require that the tenderer who has submitted the most economically advantageous tender\n based on the criteria set out in the Tender Procedure declares that the tenderer does\n not have relations to Russia that are prohibited according to Council Regulation (EU)\n 2022/576.
In accordance with the Act on the Complaints Board for Public Procurement,\n the following deadlines apply for filing a complaint:
Complaints about not being\n prequalified must be submitted to the Complaints Board for Public Procurement within\n 20 calendar days. The deadline is calculated from the day following the day on which\n the contracting authority has sent a notification to interested candidate s about\n who has been prequalified, cf. the Public Procurement Act § 171, subsection 2, or\n the Complaints Board Act § 2, subsection 1, no. 1, when the notification is accompanied\n by a justification for the decision.
In other situations, complaints about the\n procurement must be submitted to the Complaints Board for Public Procurement within\n 45 calendar days after the contracting authority has published a notice in the Official\n Journal of the European Union stating that a contract has been concluded. The deadline\n is calculated from the day after the notice was published. At the same time as filing\n a complaint with the Complaints Board for Public Procurement, the complainant must\n notify the contracting authority in writing that a complaint has been filed with the\n Complaints Board for Public Procurement, and whether the complaint has been submitted\n during the standstill period, cf. the Complaints Board Act § 6, subsection 4. If the\n complaint is not submitted during the standstill period, the complainant must also\n indicate whether a suspension of the decision is requested, cf. the Complaints Board\n Act § 12, subsection 1.
The contracting authority is entitled, but not\n obliged, to request the tenderer, the association’s participants or other entities\n to supplement or specify the received documentation, see the Utilities Directive art.\n 76 (4).
If the tenderer, the association’s participants or other entities are\n from Denmark, the documentation is presented in the form of a service certificate\n from the Danish Business Authority. The service certificate must contain information\n from:
— the probate court under the Danish District courts,
— the Danish Customs\n and Tax Administration,
— the Danish Labour Market Supplementary Pension Fund\n (ATP),
— the Police (the Danish Central Crime Register) Please note that a ‘declaration\n of consent’ must be filled in,signed and uploaded when ordering the service certificate.
The\n service certificate must be maximum six (6) months old calculated from the deadline\n for submission of the service certificate as stated by the contracting authority in\n the letter of request.
The processing time with the Danish business authority\n is approximately 2 weeks from when the order of the service certificate has been received.
If\n the tenderer, one or more of the participants in the association or other entities\n are not from Denmark, they must, as a general rule, submit the types of documentation\n stipulated in eCertis. eCertis is an online information system which must be used\n to find the right documentation to be used by EU member states in connection with\n invitations to tender.

The solvency ratio is calculated as the Applicant’s equity multiplied with\n 100 and divided by the total assets\n \n Criterion: References on specified worksDescription: The Applicant is encouraged to provide the following information about the Applicant’s\n completed experience with heat pumps and industrial buildings in part V of the eESPD.\n The experience will be based on already completed parts of the ongoing experience.
A\n maximum of five (5) references can be submitted as information under the selection\n criterion “Experience”. If more references are submitted, only the most recent references\n up to the maximum number of references will be considered. The most recent references\n will be determined based on start date.
No additional documentation for the\n selection criterion for experience will be required from the Applicant. However, the\n Contracting Entity reserves the right to contact the Applicant or relevant third parties\n for verification of the information stated in the description(s).
Please\n submit information about the Applicant's experience from the last five (5) years to\n the Prequalification Deadline, and which the Applicant has completed within such period\n (i.e. the execution end date of the reference must be within this period). The Applicant\n is encouraged to describe the following for each reference in part V of the eESPD\n or with clear references e.g. by using Annex A:
a) Name of project and country
b)\n Name of employer incl. contact person and telephone number

The\n Applicant’s experience will be based on the information submitted will be an overall\n assessment of the references (the Applicant’s experience). Taking into account both\n the relevance of each reference as well as the number of relevant references. A reference\n will be evaluated positively the more relevant the reference is considered to be.\n The more of the following elements that are contained in the reference the more relevant:
(a)\n Similarity to the Contract, including the following elements;
Design, installation,\n commissioning and testing of large heat pump system
The size of the reference\n heat pump is comparable
The heat pump has an air-based heat collector/evaporator
\n The heat pump is operated on natural refrigerant(s)
Industrial buildings for\n district heating or energy production
Construction pits (including sheet piling,\n bracing and groundwater management) and pile foundations.
Construction of site\n development, soil, drainage, paving and fencing works.
The Applicant\n must fulfil the following minimum requirement regarding experience:
The Applicant\n must have:
Minimum one relevant reference that is based on one or more natural\n refrigerant(s)
Minimum one reference that includes design, installation, commissioning\n and testing of a minimum 5 MW air-to-water heat pump system with minimum 70°C DH supply\n temperature at maximum 5°C ambient air temperature

The\n Tenderer is encouraged to;
• Provide a comprehensive description of the conceptual\n and process consider-ations underlying the requested functionalities, the robustness\n of the works, and the specified operational modes. In particular addressing:
o\n The works’ process robustness in all aspects.
o The works’ ability to operate\n in intermittent electricity markets without accelerating component wear.
o The\n works’ capacity and efficiency throughout the specified operation-al range.
•\n Describe the layout with focus on safety compliance, service and maintenance etc.,\n including how large components are handled during maintenance and replacement.
•\n Provide a quality and inspection plan for the Project.
In the assessment\n of the sub-criterion, the Contracting Entity will regard the following as positive;
a)\n That provided information demonstrate the heat pump’s conceptual design is sound and\n robust for low winter ambient air temperature and/or high DH return temperature operation;\n it has short startup/shutdown time, cold plug flow through battery limit A is avoided,\n that system availability and component re-dundancy are properly considered, and it\n delivers high load-following capability including compressor start/stop without compromising\n long-term component re-liability (i.e., low failure risk and minimal maintenance);\n the overall process-system architecture remains simple, facilitating easy access,\n easy maintenance and flexible component placement. The more detailed information provided,\n the better.
b) That explanations are provided to the heat collector conceptual\n design and its interface with the heat pump(s), including the rationale for choosing\n refrigerant or brine in the collector circuit; thorough descriptions of how the circulation\n cir-cuit is designed to avoid unintended flow regimes, such as slug flow, that could\n violate piping safety etc. as well as proper dynamic performance, circulation rates\n for refrigerant-based systems, piping diagrams. The more detailed, the better.
c)\n That it, based on analyses and thorough explanations, is demonstrated that the energy\n collector system is robust to complex and varying in-/outflow of air, air short-circuiting,\n icing of surroundings is reduced, etc.
d) That the Tenderer provides a thorough\n management strategy to condensate, frost-prevention and de-icing, with appropriate\n icing/de-icing duration curves, with details to robustness of FCUs to icing and vibration.\n The more detailed informaton, the better.
e) That safety and environmental compliance\n measures are explained, including preliminary strategies to refrigerant leakage and\n detection, safety classification (such as e.g., ATEX) of the Contracting Entity’s\n site, emergency-venting provisions, and noise issues including from safety valves.\n The more detailed, the better.
f) That the Tenderer’s quality and inspection plan\n demonstrates a thorough un-derstanding of the Contract’s quality and inspection requirements\n and is de-signed to ensure the facility immediately meets the agreed specifications\n and is fully functional upon delivery and commissioning. It will be evaluated positive,\n if the plan include provisions for Factory Acceptance Testing (FAT), and the more\n detailed and comprehensive FAT procedures will be evaluated positively. The more detailed,\n the better.
In the assessment of the sub-criterion, the Contracting Entity\n will regard the following as positive;
a. A process- and time schedule showing\n a detailed program and test, which appears responsible and well described. Furthermore,\n a plan that supports the fastest possible delivery and supports a high degree of quality\n man-agement during the delivery and test phases,
b. The more detailed, project\n specific (and relevant), coherent, and designed for continuous implementation the\n management and lessons learned procedures are, the better. It is also considered positive\n if the proposal in-cludes examples from previous projects and how this is applied\n to this project, and
c. If each CV has a competent profile with experience, qualifications,\n training and competences in relation to the project and in relation to the assigned\n role in the team, and. The Contracting Entity will pay particular attention to the\n key persons performing the following roles and tasks:
i. The Tenderer's project\n managers (primary contact persons for the Contracting Entity).
ii. Overall responsibility\n for process design carried out by the Tenderer or its subcontractors/suppliers.
iii.\n Overall responsibility for civil works carried out by the Tenderer or its subcontractors/suppliers.
iv.\n The Tenderer's construction management.

er indgået, hvis underretningen har angivet en begrundelse\n for beslutningen.
3. seks måneder efter, at ordregiveren har indgået en rammeaftale\n regnet
fra dagen efter den dag, hvor ordregiveren har underrettet de berørte ansøgere
og\n tilbudsgivere, jf. klagenævnslovens § 2, stk. 2, eller udbudslovens
§ 171, stk.\n 4.
4. 20 kalenderdage regnet fra dagen efter, ordregiveren har meddelt sin
beslutning,\n jf. udbudslovens § 185, stk. 2.
Senest samtidig med, at en klage indgives til\n Klagenævnet for Udbud, skal
klageren skriftligt underrette ordregiveren om, at\n klage indgives til Klagenævnet
for Udbud, og om, hvorvidt klagen er indgivet i\n standstill-perioden,
