Hovedpunkterne i proceduren: DRH reserves the right to award the contract based on the first negotiating tenders,\n and the tenderers may expect that the contract is awarded based on the first negotiating\n tender. In that case, the tenderers may not submit another final tender and no negotiations\n will be conducted. DRH will evaluate the negotiating tenders by using the award criterion\n stipulated in section ‎1.10..
As the tender is expected to lead to offers based\n on different commercial technical solutions and there may also be an element of new\n development of technological solutions, there may be a need for negotiations to clarify\n technical or economic questions.
If DRH chooses to conduct negotiations, the\n negotiations with the tenderers will be based on the negotiating tenders.
New\n information that may be provided to one tenderer during negotiations with that tenderer\n will, as soon as possible, be provided to the other tenderers.
DRH repeat the\n procedure by inviting the tenderers to submit a revised negotiating tender followed\n by subsequent negotiation thereof, until DRH finds it appropriate to invite the tenderers\n to submit a final tender that will be evaluated by DRH based on the award criterion\n stipulated for the procedure.
Within the framework of the public procurement rules,\n DRH is entitled to carry out conclusive negotiations with the successful tenderer\n following the award decision.

A tender who at any time during the procurement procedure\n is or becomes subject to one of the grounds for exclusion in sections 135-136 and\n 137(1),nos. 1, 2 and 3) of the Public Procurement Act, will be excluded from the procurement\n procedure unless, within a reasonable time limit set by the Contracting Authority\n the tenderes submits documentation showing the reliability of the tenderer, cf. section\n 138 of the Public Procurement Act. Preliminary documentation:
As preliminary\n documentation that the tenderer is not excluded under Sections 135-136 and section\n 137(1), nos. 1, 2 and 3 of the Public Procurement Act, and to demonstrate that the\n tenderer meets the minimum suitability requirements set out in the contract notice\n and above, the tenderer should submit a correctly completed ESPD with the application.
Final\n documentation:
For Danish tenderers, this documentation will consist of a Service\n Certificate (issued no earlier than 6 months before the tender deadline) and the three\n most recent annual accounts. For foreign tenderers, similar documentation will be\n provided by; an extract from a relevant register or an equivalent document issued\n by a competent authority, demonstrating that the tenderer is not subject to the grounds\n for exclusion set out in section 135(1) of the Danish Public Procurement Act; anda\n certificate issued by a competent authority demonstrating that the tenderer is not\n subject to the grounds for exclusion set out in section 135(3) and section 137(1),\n nos. 2 and 6 of the Danish Public Procurement Act. Upon\n request by the Contracting Authority, tenderers shall document compliance with the\n stipulated minimum requirements for economic and financial capacity by submitting\n the following documentation:
- The bidder's annual reports for the past three\n years.
- A copy of the bidder's insurance certificate.
Where, for reasons\n not attributable to the tenderer, the tenderer is unable to submit the required documentation,\n the tenderer may document its economic and financial capacity by any other means deemed\n appropriate by the Contracting Authority.

Main features of the procedure: DRH reserves the right to award the contract based on the first negotiating tenders,\n and the tenderers may expect that the contract is awarded based on the first negotiating\n tender.
